bad dealer gets even!!

first time poster yea!!!

the other day I am playing the 20 he on table 32.   I am in the six seat and am admittedly distracted by my daughter who has a crisis and is texting me.

I look up briefly and it seems the action is on me and I muck my cards.  Immediately, I realize something is not right because there is NO action behind me.  I now look up again and the dealer is pulling my cards into the muck (not really because there is no muck) in the center of the table.  As the dealer is pulling in my cards, he looks at me and says "you owe 20 to the pot"

Yes, I was the big blind and did not realize it!!  However, the next player as well as the others politely did not act expecting me to retrieve my hand.  I didnt and instead put up the Big Blind with NO hand.

I briefly thought about calling for the floor and asking for my hand back but thought better of it.  This dealer is clearly not one of the many competent dealers and I have repeatedly advised, corrected, admonished him over the years.  He had a habit of looking at the mucked cards of the players during the play of the hand which really annoyed me. We just never got along.

Of course he wont be tipped anymore and I have gotten a few of my friends to temporarily stop as well when I am at the table.  (He knows who my friends are and can easily see whats happening in the 3 downs he has dealt to me since the incident)

Should this be a lifetime ban?  Is it fair to ask my friends to help with this?

I dont want to go the the management because I just dont like [censored] with anyones job

I don't think I've ever noticed a dealer there who looked at people's mucked cards but that would upset me also.

I am also always annoyed when I make what I think of as "physical mistakes" rather than poker mistakes.  I made one yesterday in the 6/12 O8 game when I accidentally put in too many chips in on the turn and raised instead of my intended call.

I think the dealer technically made the correct move in the hand.  If someone takes the action of mucking their hand, they technically should not be allowed to retrieve it.  Having said that, when a BB folds before he realizes he is a blind, most dealers would allow them to take their hand back.  In fact, this situation would never happen with many dealers because they won't deal the last card to you until the blind is posted.

If you have a history of repeatedly admonishing him over the years, that may be part of the reason he did not let you take back the hand.  Dealers are human and subject to the same emotions as the rest of us.

Obviously because I wasn't there I couldn't really give an accurate judgment on whether I would tip anymore or not and besides, it's your decision to make.  Also, I don't think talking to the management would really affect much but if you have concerns then you have every right to do so.

 the dealer should have demanded the blind before dealing you your cards. some dealers will make you wait on the second card which is sure to get your attention. either way I don't think he would be reprimanded but it wouldn't hurt to tell mgmt, maybe they can remind the dealers of proper etiquette.

also, dealers should not look at mucked hands. I played a bar freeroll and the dealer looked at every hand and i never played again it was so ridiculous. i see it from time to time, its usually one of the regulars being too buddy-buddy with the dealer...

on another note, you do not have to tip. especially if the dealer is a jackass like the one you experienced. there are some i don't tip unless i'm really on a roll, if they are rude or just not doing a good job.

i might not have been very clear in my first ever post. 

I folded my hand when I was the big blind.  The cards were thrown about 8 inches from my seat.  The dealer clearly took a shot at me and pulled the cards in right in front of the box and then, before anyone had acted, told me I owed 20 to the pot.  It was clear to EVERYONE at the table that this was an INTENTIONAL shot at me!!!

The 7 seat saw the mistake immediately and held his action fully expecting me to retrieve my hand.  When the dealer left the table, everyone asked me what was that all about?  I told them, no big deal, he was right technically to a point, and I would have more than 20 dollars worth of fun with him in the future.

If this was just a mistake or bad judgement on his part, I wouldnt care at all but, it was clearly a shot at me.  Hes just a [censored], plain and simple.  If you knew him and knew me, you'd agree.
